Comment va la génomique en France ?

France has a new president and a new cabinet. An excellent reason for me to continue a series on genomics in different countries, which has already covered Japan and Germany.

In June 2000, the first draft of the human genome was completed. The contribution of France was 3% of the total. That was little, but still more than the contribution of any other country except the United States and the UK. At the time, all of the sequencing in France was done by its national sequencing centre, the Genoscope near Paris.

Since then, genomics has become even less of a national priority, and other countries have overtaken France. In terms of sequencing infrastructure, France lags behind its European peers Germany and the UK. According to Omics Maps, there are 38 sequencing machines in France, compared to Germany's 135 and the UK's 138.

There are some signs that this could change. Last year, French genomics, including the Genoscope sequencing centre, received a funding boost of €60m ($77m) as a part of a €260m packageto promote research infrastructure. It is too early to tell whether this has been a one-off, or whether there is a long-term commitment by French policymakers to invest more in genomics. Doing a quick press search, I could not find any indication what the views of France's new minister of Higher Education and Researchon genomics are.

How about the private sector? France has biotech giants such as Biomérieux and Eurofins that are also involved in sequencing.  However, the core business of both companies is not genomics. That is unlikely to change: In a recent interview, Eurofins senior vice president Bruno Poddevin expressed the opinion that it will take at least another 10 years until Sanger sequencing is replaced by next generation sequencing (NGS), and that until then, NGS will not be a priority for his company.

Overall, it seems that sequencing is not a priority for either the public or the private sector in France. If you have any comments that confirm or refute this view, please share them below. CONTRACT INTERPRETATION REVISITED

Many, if not most, problems during contract performance arise over differing interpretations of contract requirements.  The same is true of most contractor claims under or related to contracts: they arise over differing interpretations of contract language.  So far, our most popular blog posting discussed the rules of contract interpretation enunciated in a recent Armed Services Board of Contract Appeals (ASBCA) opinion authored by Judge David James.

The rules have been around a long time and the final authority really is the Court of Appeals for the Federal Circuit (CAFC) since the U.S. Supreme Court seldom gets involved in federal procurement cases.  Judge James based his recent recitation of the rules based on the CAFC precedent.  Another ASBCA jurist, Judge Carol Park-Conroy, has stated the rules this way:
To prevail upon its parapet wall claim, SRC [the contractor] initially must demonstrate either that its interpretation of the contract is the only reasonable interpretation or that the contract was ambiguous.  The rules of contract interpretation are settled.  We are to read the contract as a whole and give it meaning that makes sense.  A contract is unambiguous if there is only one reasonable interpretation.  Conversely, a contract is ambiguous if it is susceptible to more than one reasonable interpretation.  It is not enough to demonstrate there are two different interpretations; rather, both must be within the 'zone of reasonableness.'  Ambiguities will be construed against the government as the drafter under the doctrine of contra proferentem, so long as the contractor relied upon its interpretation during bid preparation.  An ambiguity is patent if it contains glaring errors or patently obvious conflicts.  (Citations omitted.)
If the ambiguity is glaring or obvious, the contractor has a duty to inquire as to the contract language meaning before submitting its bid or proposal.  If the contractor fails to discharge that responsibility, it assumes the risk that the language will be interpreted against it.  If the contracting officer fails to clarify the language, the contractor still must assume the risk, or, of course, not submit its bid or price the risk accordingly.

We cannot overemphasize the point that the practical effect of these rules is the premium both buyer and seller should place on review of contract documents for clarity.  The government, as drafter, bears the initial responsibility.  But the contractor has a duty to inquire about obvious ambiguities and assumes the risk if the government does not clarify.  It is perfectly proper to protest to GAO before bidding if the language is not cleared up.  We should hasten to add that the ASBCA has said the contractor has no duty to "ferret out hidden ambiguities" and that a contractor only has a duty to read the solicitation for the purpose of preparing a proposal in response.

A Picture is Worth .....

The pic tells it all. First aggressive entry may be only 50%, but the second one is "all in" as they say in Hold 'Em. The only real decision to make was whether to cover it all at the support or believe that the support would break during the session.  Leaving a runner with a break-even stop/ OCO/ MOC and going to the beach could be one option.


Originality

Has anyone else noticed all the remakes lately? I turn on the radio and a surprising number of "new" hits are actually remakes of old songs. Either that or they are at least heavily sampling something from the past. It's the same with movies. I could hardly believe it when they remade Footloose last year! And now in 2012 there are remakes like 21 Jump Street and Fright Night. Next year, I hear they are coming out with a new Superman and even remaking Steel Magnolias. It makes me wonder: Where are all the original ideas?

I think what bothers me most about some of these remakes is that sometimes it just seems that the studios or musical artists just want to make a quick buck. Rather than put in the time and effort of actually doing something new or original, they simply hire new actors to tell the same exact story in the same exact way. Then, they push it out to the public saying, "Remember this movie you loved when you were younger? You've just got to go see the remake, it's awesome!" Something about it feels so manufactured and passionless.

But what about when a true artist takes an old story and makes something new out of it? The Dark Knight series of Batman remakes has been amazing and I honestly can't wait for The Dark Knight Rises this summer. On the other hand, that series still has unique elements that weren't there in the original films. Of course, you could also say the films were just a remake of the comic books since that's where Batman got his true start, but at least the Batman Begins trilogy tells the story in a new way.

What about Snow White and the Huntsman? Old story. New twist. In the previews at least, I haven't seen any reference to seven dwarves. I haven't seen Snow White in the kitchen whistling and cooking for seven tiny men or roaming through the happy woods with deer. Instead, there are scenes with her in full body armor, wielding a sword and shield. I think I'm going to like this Snow White (even if I don't always love Kristen Stewart).



When a remake is done with a totally new twist, it can be powerful and exciting. Then again, when it's just a straight remake, I often get frustrated and confused. If you're not improving on it, why do it? Just to make money? I'd much rather see people take a risk on something original than something regurgitated. That's one reason I love this new revolution of self-publishing. I love the freedom so many authors have now of telling their own stories in their own unique way (or completely reimagining something old and giving it an exciting new twist). Less limitations and more creativity in story-telling is much more exciting to me than straight remakes of something that's been done several times before.

POST AWARD PROTEST TIMELINESS RULES

The first rule is not to protest unless the government has violated an acquisition regulation. The most common violation is the government’s failure to follow the announced evaluation factors.

The second rule is to move fast.

After you find out you lost the award, you must request a debriefing, in writing, within 3 calendar days. If the last day falls on a weekend or holiday, the deadline is the next business day and this is true of all the calendar day calculation rules. (Insist that the government adhere strictly to the requirements of FAR 15.506.) You then have 10 calendar days after the debriefing to file a protest at GAO. If you don’t ask for a debriefing, you have 10 calendar days after notification of award to protest to GAO (you must protest within 10 days of actual or imputed knowledge of the grounds for protest).  Note however, if you want to invoke the statutory stay of award or performance on the contract, these time requirements change.

When the government receives notice of a protest from GAO (be sure GAO promptly provides this notice), within 10 calendar days after award or within 5 days after a debriefing, whichever is later, the contracting officer must immediately suspend performance on the awarded contract. Notice the rule here is 10 days after award, not 10 days after you receive notice of the award. This is another reason to request the debriefing to allow time for imposition of the automatic suspension of performance pending GAO’s decision on the protest. Note also the rule is 5 days after debriefing for suspension of award or performance.

If you miss these deadlines, you are out of luck in protesting at GAO. However, if you act with reasonable promptness, you can still protest at the Court of Federal Claims (COFC). In fact, you can get a second bite at the apple at the COFC even if you lose at GAO. The COFC has disagreed with GAO on several occasions.


Suspension of performance can be overridden by the head of the contracting activity, on a non-delegable basis if urgent and compelling circumstances that significantly affect the interests of the government will not permit waiting for the GAO decision or contract performance is in the best interests of the government. The resumption of contract performance, however, can be challenged in the COFC in an action testing the propriety of the decision to override the suspension of performance. In a good number of these cases, the COFC has disagreed with the government.

If your grounds for protest involve the propriety of language in the solicitation, you already are too late. Those protests much be sent to GAO before the time for submission of bids.

YOU DON’T HAVE TO REMEMBER ALL OF THIS. JUST HEED THIS WARNING THAT THESE TIME LIMITS ARE STRICTLY ENFORCED AND YOU MUST MOVE QUICKLY IF YOU THINK YOU MAY WANT TO PROTEST.

My Friends..... the time has come to take our power back!!!!  This is IT.  THIS is the time. THIS is the NOW.  

All over this glorious planet of ours people are standing up.  They are standing up for all sorts of reasons, but they are unified in one action: THEY STAND UP! 

Make your stand how ever you want, but make your stand!  The media controllers are doing all they can to try to convince the world that those standing up are but a few dissonant rebellious youths who just want to make trouble and make a fuss.  BUT.... their control of their own media is very quickly slipping through their fingers.  The news is leaking out so fast now, that the tiny cracks that appeared in the dam last year are now threatening to become a high pressured deluge that will burst from the confines of iron control.

The media is being made a fool of, and they know it.

A media outlet had the audacity this past weekend to say that this protest march was attended by "a few hundred" students: 

... either they've lost the ability to count, or they're desperately trying to cover up the reality of hundreds of thousands of people taking to the streets, with pots & pans in a peaceful, yet not very quiet, protest in Montreal Canada.

If we make enough noise, they will not be able to ignore us. 

As an interesting little side note, Wassailing is a tradition where people gather together to make lots of noise to scare away the evil spirits to help insure a good crop the following year.  The tradition of making loud noises to scare away "evil spirits" is seen through out many many ancient traditions all across the globe.

BUT... it's not enough!  One Thursday a MONTH?!  NO!  Not nearly enough! 

My friends, I know what I know and I know that the Cabal is on the run.  They are in a desperate panic and running around like chickens with their heads cut off.  Actually, they are more like a beheaded snake, writhing on the ground.  The fangs are still dangerous and filled with poison, but these last agonising convulsions are the flailing thrashings of an already lifeless being.

The evil snake may be in it's dying throes, but now is not the time to sit back and watch the floor show.  Now is the time to push forward even stronger. Now is the time to stand up and make sure that any snakes that remain know that we are here and we are NOT going away.  We are awake and aware and we will not go quietly into their night.

Yes, the banging of pots & pans.  Let the noise become so loud all over this world that it wakes the sleepers and becomes a siren call to every human on this planet to Stand Up.

EVERYDAY of EVERY Month.

There is a presence of negative energy on and around this planet- the last thread-like web of control, being held together by the withering entities that thought they could control us and keep us in a drug and media induced slumber.  NOW is the time to break those tiny weakened strings that are binding our planet to their influence. 

Like the old traditions of scaring away the "evil spirits" with the banging of drums and the ringing of bells, let us clear away these last negative entities!
